Earlier this week, the Wisconsin Court of Appeals dealt a blow to the efforts of Wheaton Franciscan Healthcare to obtain a property tax exemption for Wheatons hospital outpatient center in Wauwatosa. If this decision stands, it could potentially endanger the tax exempt status of all hospital outpatient facilities, whether on campus or off campus.

Wheaton wins tax exemption case

The Wisconsin Supreme Court upheld the tax-exempt status of a Wheaton Franciscan Healthcare outpatient facility in Wauwatosa on Tuesday, reversing a Court of Appeals decision on a case closely monitored by health care providers statewide.

Off-Campus Hospital Outpatient Qualify for Property Tax Exemption

The Wisconsin Supreme Court affirmed that offcampus hospital outpatient facilities qualify for Wisconsin property tax exemption. By a 6-1 vote, the Supreme Court held that a hospital outpatient facility operated by Wheaton Franciscan Healthcare in Wauwatosa is exempt from the property tax under the same statute that exempts hospitals.
